The services of Sukhijeevan are subject to the following Terms and Conditions and the persons registering/availing its services (‘Users’) agree to have read and be bound by the said Terms and Conditions.

PROVISION OF SERVICES

• Sukhijeevan is intended to serve only and exclusively as a preliminary medium for exchange amongst its Users, matrimonial profiles, received from its Users, of persons who have bonafide intention to enter into a matrimonial alliance.
• Acceptance/Registration of a User is entirely upon the sole discretion of Sukhijeevan. Sukhijeevan reserves the right to reject Registration or refuse to provide its services to a person and refuse to provide its services to any existing User, at any time without assigning any reason whatsoever.
• It is entirely for the Users themselves to carefully and properly read, understand and if necessary, verify the information provided in the profiles before entering into a matrimonial alliance or even proceeding further with a profile. Sukhijeevan does not verify or investigate the profiles received and shared with the Users and does not in any manner vouch for the correctness or authenticity of the same.

ELIGIBILITY

• The matrimonial profile should be of a person who has bonafide intention to marry and is legally competent and of legal marriageable age as per the laws of the country of Residence/citizenship (currently, in India, 18 years or above for females and 21 years or above for males).
• The Users represent and warrant that they have the right, consent, authority and legal capacity to utilise the services, provide the matrimonial profiles, submit relevant information and are not prohibited or prevented by any applicable law for the time being in force or any order or decree or injunction from any Court, Tribunal or any other such competent authority restraining them from providing the profiles for matrimonial alliance.

CODE OF CONDUCT

• The Users agree and undertake to keep all information provided to them by Sukhijeevan as strictly private and confidential.
• The profiles shared and/or the information provided to the Users are for their private consumption and solely for the purpose of finding a suitable match for matrimonial alliance. The Users agree that the same shall not be used commercially or in any manner shared, misused or used for purpose other than intended.
• The Users undertake to provide and share with “Sukhijeevan”, genuine profiles containing details and information which are factually correct, without giving any false, wrong or misleading information and without concealing or holding back any information, detail or fact as may be necessary for the purpose of enabling a person/user to proceed further in the matter of matrimonial alliance.
• The Users agree and undertake to maintain utmost decency and courtesy in all their communications and interactions and not to send or share any frivolous, indecent, obscene or unwarranted message, information, detail, pictures, etc. with any person whose contact details or e-mail id has been shared through or by Sukhijeevan.

USER FEE AND MATCH-MAKING FEE

• The Users agree and undertake to pay before the first meeting of families, a User fee of Rs. 11,000/- and a Match-Making fee of Rs. 40,000/- after the Roka/engagement or similar ceremony.
• The User fee and/or Match-Making fee paid by any User to Sukhijeevan is non-refundable and non-transferable to any other User/person.

INDEMNITY

• The Users understand and agree that use of services of Sukhijeevan is subject to limitations, conditions and restrictions as may be imposed at any time at the sole discretion of Sukhijeevan.
• Sukhijeevan may alter, suspend or discontinue any or all aspect of the services at any time.
• Sukhijeevan may also impose limits on certain features and aspects of the website or restrict the access to any or whole part of the website without prior notice or liability.
• The Users understand and agree that exchange of any profile through or by Sukhijeevan shall not in any way be construed as a matrimonial offer and/or recommendation and/or advice or guarantee given to its Users.
• Sukhijeevan shall not be in any manner liable or responsible for any wrong, false, incorrect or misleading details or information given in a profile by a User and the Users agree and undertake not to hold Sukhijeevan responsible for any lacunae/falsity, etc. in the profile shared or in case anything goes wrong or any claim/action etc. initiated between the families at any time before or after the matrimonial alliance.
• Sukhijeevan does not guarantee or assure to its Users surety of a matrimonial alliance or of providing any fixed number of profiles. Sharing of profiles is at the sole discretion of Sukhijeevan.
• The Users agree and undertake to keep Sukhijeevan indemnified against any loss, damage, injury or claim whatsoever which might occur as a direct or indirect result of any action of its User(s).

MEMBER DISPUTES

• The Users are solely responsible for communication with each other. Sukhijeevan reserves the right to take appropriate action against errant Users. Sukhijeevan also expressly disclaims any responsibility or liability for any interactions between the Users.

DISPUTES RESOLUTION

• Any question, dispute or difference arising out of these Terms and Conditions or arising out of or in connection with the services provided shall be first attempted to be resolved through Mediation.
• In case of failure to resolve through Mediation, the same shall be referred to a Sole Arbitrator to be appointed by the Service Provider within 30 days of the written request from the User.
• The venue/seat of Arbitration shall be at Jaipur.
• The decision of such Arbitrator shall be final and binding upon the parties.
• The cost of proceedings shall be borne equally by the parties.
• Any reference under this clause shall be deemed to be a reference to arbitration within the meaning of the Arbitration and Conciliation Act, 1996.
• For the purpose of Jurisdiction, these Terms and Conditions shall be deemed to be accepted by the User at Jaipur.

EXCLUSIVE JURISDICTION

• The Users unconditionally and unequivocally agree that all such disputes and/or differences will be governed by the laws of India and shall be subject to the exclusive jurisdiction of the Competent Courts in Jaipur only.

TERMINATION/REVOCATION OF MEMBERSHIP

• Sukhijeevan reserves the right to terminate, without assigning any reason, access of the website or the provision of its services to any User.
• In case of breach of any of the terms and conditions contained herein or the User being found to be indulging in any indecent, malicious, unwarranted or illegal behaviour or act, Sukhijeevan reserves the right to take appropriate legal action including but not limited to termination of its services and recovery of its User Fee and/or Match-Making Fee.

COPYRIGHT POLICY

• The Users agree not to post, distribute, or reproduce in any way, any copyrighted material, trademarks or other proprietary information without obtaining the prior written consent of Sukhijeevan.

MISCELLANEOUS

• Sukhijeevan reserves the right to verify, if deemed necessary, the authenticity of the bio-data and any other information provided to it. If circumstances warrant, Sukhijeevan may call for any of its Users to provide documentary and/or other form of evidence in support of the information given.
• Sukhijeevan reserves the right to modify the terms and conditions at its own accord and such modifications shall bound the Users with immediate effect.

DISCLAIMER

• The exchange of matchmaking profile(s) through or by Sukhijeevan is not a matrimonial offer and/or recommendation from/by Sukhijeevan. Sukhijeevan shall not be responsible for any loss or damage for any individual arising out of, or subsequent to, any relations (including but not limited to matrimonial relations) established pursuant to the availing of services of Sukhijeevan.
• Sukhijeevan expressly disclaims any liability or responsibility whatsoever and howsoever arising as a result of any profile made available to Sukhijeevan by the Users or any third party.
• Sukhijeevan does not engage in astrological predictions and makes no warranties or representations regarding the accuracy or significance of any aspect of the astrological horoscope and cannot be held responsible for any interpretations or use that may be made of it by the Users.
• Under no circumstances and under no legal theory, tort, contract, or otherwise, shall Sukhijeevan or its management be liable to the User or any other person for any indirect, special, incidental, or consequential damages.
• It is understood that the materials provided are for your personal information only and do not construe to be any specific advice to you. We shall not be held responsible for personal or business losses arising from using or not using our services in any way. Please use your own discretion when following our advice. Any action taken by the User on the basis of the information is User’s responsibility alone and Sukhijeevan will not be liable in any manner for the consequences of such action taken by the User.
• User-Fee and/or Match-Making Fee is subject to change from time-to-time.
• Any change in Fees shall not be applicable to the existing paid Users.
• Fees once paid is non-refundable and non-transferable in any circumstances.
• The User shall at all times be bound by the Terms and Conditions.
• That all the disputes arising under Terms & Conditions or Disclaimer shall be dealt at Jaipur in accordance with the mechanism stated in Terms & Conditions under Jurisdiction and Dispute Resolution Clause.
